1. Warranty Coverage
Final Finish Flooring, LLC ("Final Finish") provides this limited warranty to the original consumer purchaser ("Customer") for the Citadel Floor Finishing System installed by Final Finish on residential garage concrete floors. This limited warranty covers both labor and materials, ensuring peace of mind and confidence in the quality and durability of our floor coatings.
A.Residential Garage Floor Coatings
Duration:
The floor coating is warranted for a period of fifteen (15) years from the date of substantial completion of the work performed by Final Finish.
Coverage:
This warranty covers:
- Peeling or Delamination: The coating will not peel or delaminate from the concrete surface under normal use conditions.
- Stain Resistance: The coating will resist staining from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel, provided such spills are promptly wiped up within 20 minutes of occurrence.
- Moisture Resistance:
- For floors without a vapor barrier: Warranty covers up to 8 lbs of moisture vapor pressure per 1,000 square feet per 24 hours.
- For floors with an installed vapor barrier due to high moisture content: Warranty covers up to 25 lbs of moisture vapor pressure per square inch.
2. Labor and Material Warranty
Final Finish Flooring, LLC’s warranty includes both labor and materials necessary to repair or replace any defective area covered under this warranty. If a defect arises within the warranty period, Final Finish will, at its discretion, repair or replace the defective portion of the floor coating at no cost to the Customer.
3. Exclusions
This Limited Warranty does not apply to, and Final Finish will not be responsible for:
- Improper Use or Maintenance: Damage caused by improper maintenance, misuse, abuse, or neglect.
- Accidents or Impact: Damage resulting from accidents, impact, fire, flood, or other natural disasters.
- Chemical Exposure: Damage caused by exposure to chemicals not recommended for contact with the System, including but not limited to battery acid, brake fluid, and other industrial fluids.
- Substrate Movement: Damage caused by cracks or shifting in the concrete substrate, including pre-existing cracks that reappear due to concrete movement or street creep.
- Industrial or Heavy Equipment: Damage or defects caused by the use of industrial vehicles, heavy equipment, or vehicles with tracks.
- Extreme Temperatures and Environmental Factors: Damage due to exposure to extreme temperatures or environmental conditions that exceed the product's specifications.
- Acts of God or External Factors: Any failure, delay in performance, defects, or damages caused by acts of God (such as floods, fires, or storms), acts of civil or military authority, or any other causes outside the Contractor’s control.
- Damage to Personal Property: This includes incidental dust and other effects resulting from the installation process.
4. Warranty Claims
To make a claim under this warranty, the Customer must:
- Notify Final Finish in writing within 30 days of discovering the defect. The notification must include proof of purchase, the date of installation, and a description of the defect.
- Allow Final Finish or its representatives reasonable access to inspect the floor and perform necessary tests to determine the nature of the defect and the coverage under this warranty.
- If Final Finish determines the claim is valid, it will repair or replace the defective area at its discretion. The repair or replacement will be done using materials of comparable quality to the original System.
5. Limitation of Liability
Final Finish’s liability under this warranty is limited to the repair or replacement of the defective area. In no event shall Final Finish be liable for incidental, consequential, or punitive damages, including but not limited to loss of use, loss of profits, or inconvenience.
6. Non-Transferability
This limited warranty is non-transferable and applies only to the original consumer purchaser who purchased the System. Any sale or transfer of the property where the floor coating was installed voids this warranty.
7. Governing Law
This warranty shall be governed by and construed in accordance with the laws of the State of Georgia. Any disputes arising under or in connection with this warranty shall be resolved exclusively in the courts of the State of Georgia.
8. Severability
If any provision of this warranty is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
